Effective as of 1 July 2025

Article 1 – Definitions

1. The Club | The company registered with the Dutch Chamber of Commerce under the name BBM Gym.
2. Member(s) or you | The individual(s) entering into an agreement with BBM Gym.
3. Agreement | The membership contract between BBM Gym and the Member, including these general terms and conditions.
4. Activities | All sports and training sessions offered by BBM Gym, including group classes such as boxing, kickboxing, MMA, strength training, Hyrox sessions, Open Gym access, and Personal Training.

Article 2 – Applicability & Amendments

These terms apply to all agreements between BBM Gym and the Member.
The most current version is available at www.bbmgym.nl.
BBM Gym may amend these terms. Changes will be communicated at least 4 weeks in advance. If a change is disadvantageous, the Member may cancel the agreement free of charge within that period.

Article 3 – Offer & Cooling-Off Period

1. Offers are made in writing or electronically and are valid for 2 weeks, unless stated otherwise.
2. The agreement includes: offer details, fees, duration, termination notice, payment structure, terms, and rules.
3. After signing, the Member has a 7-day cooling-off period to cancel free of charge.

Article 4 – Membership & Duration

1. BBM Gym offers two types of membership:
   1. Annual membership (group classes): fixed duration of 52 weeks (13 periods of 4 weeks);
   2. Ongoing membership (group classes): no fixed term, renewed every 4 weeks.
2. All memberships are billed every 4 weeks. There are 13 billing cycles per calendar year.
3. Memberships are strictly personal and non-transferable.
4. Access to facilities is only valid with an active membership.
5. BBM Gym reserves the right to refuse membership applications without providing a reason.
6. Children & Parental Supervision
   1. Children under the age of 16 can only become members with written consent from a parent or legal guardian.
   2. This guardian is jointly liable for payment and conduct.
   3. BBM Gym may limit children’s participation to specific class types or require parental supervision.

Article 5 – Termination & Renewal

Annual membership:

1. 1. Runs for 52 weeks and is automatically renewed in 4-week cycles.
   2. After the first year, termination is possible with a notice period of one full 4-week cycle.

Ongoing membership:

1. Renews every 4 weeks.
   Termination is possible with a notice period of one full 4-week cycle.
2. Termination can be done in writing, via email, or through the Virtuagym app.
3. Early termination with 1 period’s notice is allowed in case of:

• • Medically proven long-term injury or illness (with doctor’s note);

  • Relocation more than 25 km from the gym (with official proof of address change).

4.  BBM Gym may terminate the agreement immediately in case of:

• • Repeated or serious violation of rules;

  • Undesirable behavior or violence;

  • Non-payment of more than 2 installments.

Article 6 – Payment & Price Changes

1. All payments are made by direct debit, in advance, every 4 weeks.
2. Rates may be adjusted once every 12 months.
3. Statutory levies (e.g., VAT) can always be applied immediately.
4. In case of increases beyond legal indexation, the
5. Member has the right to cancel the contract free of charge within 4 weeks (if the contract is indefinite).

Article 7 – Failed Payments & Collections

1. If a payment fails or is reversed, a second attempt will be made.
2. A €10 administration fee (charged at cost price of the payment system) applies per reversal.
3. If payment is not made within 14 days of the reminder:

• • Statutory interest and collection fees may be charged;

  • Access to the gym may be blocked;

  • The claim may be transferred to a debt collection agency.

4. A reversal within 8 weeks does not void the payment obligation.

Article 8 – Membership Suspension (Freezing)

1. In case of injury or illness (with supporting evidence), a membership may be frozen once (minimum 1, maximum 3 periods of 4 weeks).
2. The suspension extends the membership duration.
3. Suspension is not retroactive and cannot coincide with termination.

Article 9 – Schedule Changes, Closure & Force Majeure

1. BBM Gym reserves the right to adjust opening hours, class schedules, and instructors due to seasonal changes, holidays, maintenance, or force majeure.
2. In case of unforeseen closure lasting more than 7 days, the membership will be extended free of charge or compensated pro rata.

Article 10 – Liability & Risk

1. Use of facilities and participation in training is entirely at your own risk.
2. The Club is only liable in cases of proven intent or gross negligence.
3. The Club is not liable for loss, damage, or theft of personal belongings.

Article 11 – Conduct & Safety

1. Members must follow staff instructions and the house rules.
2. It is prohibited to exercise under the influence of alcohol, drugs, or doping.
3. Undesirable behavior such as (sexual) harassment, discrimination, or aggression will result in immediate termination of membership.
4. Members must update their contact details in a timely manner.

Article 12 – CCTV & Media

1. The gym is monitored by CCTV for security purposes. Footage is processed in accordance with the GDPR.
2. Media used for marketing purposes will only be published with the Member’s explicit consent.

Article 13 – Privacy
Personal data is processed in accordance with applicable GDPR legislation. BBM Gym’s privacy policy is available via the Virtuagym app and at www.bbmgym.nl.

Article 14 – Complaints Procedure

1. Complaints must be submitted in writing within 1 month of discovery.
2. BBM Gym will respond within 14 days. If more time is needed, the Member will receive an update within that period.

Article 15 – Applicable Law
Dutch law applies to these terms and all agreements. Disputes will be submitted to the competent court in Maastricht.
